TERMS AND CONDITIONS OF USE

This is a legal agreement between you ("The Webmaster") and SensiClick.com. This agreement concerns The Webmaster's registration to a system in which SensiClick.com agrees to:

a) send visitors to a URL specified by The Webmaster
b) pay The Webmaster for sending visitors to a URL specified by SensiClick.com

This agreement supersedes any other understandings or agreements, including, but not limited to, advertising with respect to the service. By joining SensiClick.com, The Webmaster agrees to be bound by the following terms and conditions.

A) TERMS AND CONDITIONS TO PEOPLE BUYING TRAFFIC

  1. Only one (1) SensiClick.com account is allowed per person, company or organization.


  2. The Webmaster must be of legal age to buy traffic from SensiClick.com.


  3. SensiClick.com reserves the right to cancel this program at any time. In such case, The Webmaster will be notified immediately and paid all funds held by SensiClick.com.


  4. The prices of the SensiClick.com services are fully dynamic and SensiClick.com reserves the right to change them at any time, without prior notification.


  5. Every page that The Webmaster is buying traffic to must be in compilance with "The Rules" placed in SensiClick.com's webmaster area. The rules include, but are not limited to: maximum of 50% blind links on the page, no practices that result in a page that could be termed as an "unclean". SensiClick.com reserves the right to change the rules at any time, without prior notification.


  6. The Webmaster is guaranteed that SensiClick.com will send the exact number of visitors that The Webmaster specifies to the URL that The Webmaster specifies. However, the only authoritative number of visitors that have been sent, is the number in SensiClick.com's database. In no event shall SensiClick.com accept complaints based on ANY other visitor counting practices (including, but not limited to 3rd-party counters).


  7. The guarantee stated in the previous point is the only guarantee for SensiClick.com. In no event shall SensiClick.com be liable for any consequential, direct, indirect, incidental, punitive, or other damages whatsoever (including, but not limited to, damages for loss of profits, loss of information or other pecuniary loss) arising out of the use or inability to use the service, even if SensiClick.com has been advised of the possibility of such damages.


  8. SensiClick.com will not deliver visitors to sites engaged in, promoting, linking to or having apparent links to inappropriate content. Inappropirate content includes, but is not limited to, obscene or illegal content, hate text, illegal content and content that encourages illegal activities or violence.


  9. SensiClick.com cannot be held responsible for factors beyond our control that may interfere with our ability to deliver visitors. Such factors include, but are not limited to: downtime on The Webmaster's server, overuse of your bandwidth quota (if applicable), errors on your site and network or supply outages beyond our servers.


  10. SensiClick.com also cannot be held responsible for accidental factors. Such factors include, but are not limited to SensiClick.com's server downtimes, errors on SensiClick.com's site and network. However, in such cases, SensiClick.com may provide a compensation to The Webmaster.


  11. Payments for services provided by SensiClick.com are entirely made by funds with which The Webmaster loads his SensiClick.com account beforehand (using any of these payment methods: Credit Card, PayPal, ePassporte, Wire Transfer). Due to the service pattern that SensiClick.com provides, it is not possible for The Webmaster to get a refund once some of the money has been spent in the SensiClick.com network, unless The Webmaster provides a conlusive proof that SensiClick.com did not provide the services or did not comply with the guarantee stated in point 6 in this part (A) of the agreement.


  12. Any data in the SensiClick.com's database (including, but not limited to: the number of visitors delivered, external transactions, internal transactions) is conclusive, unless there is a conclusive proof that it is not.


  13. The Webmaster must provide SensiClick.com with correct legal name, address and contact information, as this agreement is a legally binding contract between The Webmaster and Martin Fronek.


  14. SensiClick.com reserves the right to terminate any account that is in violance of any of the statements above. Once an account is terminated, The Webmaster's claim on getting any money held by SensiClick.com back extincts.


B) TERMS AND CONDITIONS TO PEOPLE SELLING TRAFFIC

  1. Only one (1) SensiClick.com account is allowed per person, company or organization.


  2. The Webmaster must be of legal age to sell traffic to SensiClick.com.


  3. SensiClick.com reserves the right to cancel this program at any time. In such case, The Webmaster will be notified immediately and paid all funds held by SensiClick.com.


  4. The payout rates are fully dynamic and SensiClick.com reserves the right to change them at any time, without prior notification.


  5. Every page that The Webmaster is sending traffic from must be in compilance with "The Rules" placed in SensiClick.com's webmaster area. The rules include, but are not limited to: maximum of 50% blind links on the page, no practices that result in a page that could be termed as an "unclean". SensiClick.com reserves the right to change the rules at any time, without prior notification.


  6. In no event shall SensiClick.com be liable for any consequential, direct, indirect, incidental, punitive, or other damages whatsoever (including, but not limited to, damages for loss of profits, loss of information or other pecuniary loss) arising out of the use or inability to use the service, even if SensiClick.com has been advised of the possibility of such damages.


  7. SensiClick.com will not pay for traffic coming from sites engaged in, promoting, linking to or having apparent links to inappropriate content. Inappropirate content includes, but is not limited to, obscene or illegal content, hate text, illegal content and content that encourages illegal activities or violence.


  8. SensiClick.com cannot be held responsible for factors beyond our control that may interfere with our ability to pay for the traffic.


  9. SensiClick.com also cannot be held responsible for accidental factors. Such factors include, but are not limited to SensiClick.com's server downtimes, errors on SensiClick.com's site and network. However, in such cases, SensiClick.com may provide a compensation to The Webmaster.


  10. Any data in the SensiClick.com's database (including, but not limited to: the number of visitors delivered, external transactions, internal transactions) is conclusive, unless there is a conclusive proof that it is not.


  11. SensiClick.com reserves the right to not count traffic from specific sources if their traffic quality is out of the limits given by the payment schedule, without closing the account. The Webmaster must be notified about it in SensiClick.com's webmaster area.


  12. The Webmaster must provide SensiClick.com with correct legal name, address and contact information, as this agreement is a legally binding contract between The Webmaster and Martin Fronek.


  13. SensiClick.com reserves the right to terminate any account that is in violance of any of the statements above. Once an account is terminated, The Webmaster's claim on getting any money held by SensiClick.com back extincts.
